(1) Information concerning the handling and processing of personal data in accordance with the principle of transparency Article 12 ff GDPR

Purpose

Our company handles and processes personal data in order to initiate business relationships and in order to fulfil the respective engagements under these. This affects all data categories in order to fulfil pre-contractual and contractual obligations. Personal data will only be passed on to third parties if this is necessary in order to fulfil the purpose of the transaction. A transfer of personal data to third parties, also in third countries where the data protection level is unclear (as a rule countries outside the EU) who are not involved in the purpose of the transaction does not take place or only takes place if the affected person has issued his or her consent.

In such a case, the gathering, processing and use of personal data takes place within the legally permitted framework in accordance with Articles 5 and 6 GDPR. Should personal data be gathered from the affected person, in accordance with Article 12 ff GDPR and § 32 of the German Federal Data Protection Act (BDSG), he or she has the right to receive transparent information. As a rule, only information which is necessary in order to fulfil the business task and which is directly connected to the purpose of the processing is processed and used. In such a case, the special requirements for the gathering, processing and use of special categories of personal data which are set out in Article 9 GDPR and § 22 ff BDSG are complied with. In accordance with the GDPR, the handling and processing of sensitive data is only permitted in accordance with the principle of reservation of consent or if a legal basis for this is present.

The rights of affected persons

In accordance with Article 15 ff GDPR, affected persons have the right to information, correction, deletion and restriction in relation to the handling and processing of their data, as well as the right to raise an objection in this respect.

Furthermore, in accordance with Article 13 Paragraph 2 Letter c) GDPR, affected persons also have the right to revoke their consent to the handling and processing of personal data with effect for the future, should the processing be carried out under Article 6 Paragraph 1 Letter a) or Article 9 Paragraph 2 Letter a) GDPR. The lawfulness of the processing which was consented to prior to the time of revocation is not affected in such a case.
However as a rule, should the consent be revoked or should the necessary data not be provided, this means that the purpose for which the data was gathered or for which the data needed to be obtained cannot be fulfilled. Deletion of personal data

Personal data is deleted once the purpose for the saving is complete and as long as no legal norm (for example the statutory retention period) requires the data to be retained. The provisions of Article 17 GDPR and § 35 BDSG apply. Should the deletion not be possible due to statutory or contractual reasons or for reasons under commercial or tax laws, the processing of the data can be restricted following a request by the affected person. Written form is sufficient for claiming the right.

The right of the affected person to data transferability

The company safeguards the right to data transferability in accordance with Article 20 GDPR. Each affected person has the right to receive a copy of his or her personal data in a standard machine readable file format.
